Can a lost or destroyed Title be replaced?
Yes. Accidents happen! In the event your title is lost or destroyed, it is imperative that you apply for a replacement. Section 33 of the Land Registration Act provides for the process.
Process of Replacement
Report the matter to the nearest police station to obtain a police abstract. This is a crucial step to protect yourself from potential fraud arising from the lost title.
An Advocate of the High Court will prepare the following requisite documents on your behalf:
- Form LRA-12: The official application for replacement.
- Newspaper Notice: Publish notice of the lost title in two newspapers of national circulation.
- Statutory Declaration: A sworn statement by the individual owner or a company director.
- Deed of Indemnity: Indemnifies the Land Registrar from claims arising from the process.
- KYC Documents: Certified KRA PIN, IDs or Certificate of Incorporation, and passport photos.
- Ownership Proof: Certified copy of the title, a recent Official Search, and a survey map.
Your Advocate will submit the complete set of documents through the appropriate Lands Registry or via the Ardhi Sasa platform, depending on the property's location.
Upon submission, the Registrar reviews the application. If all documents are in order, the notice of loss is published in the Kenya Gazette for a period of sixty (60) days.
Once the sixty-day gazettement period lapses without objection, your Advocate can visit the Lands Registry to be issued a Provisional Certificate of Title, which has the same legal standing as the original.
